To the landowners in the Ledge Wind Project:

If you believe wind turbines are a good fit for a farm operation, a free source of clean energy, and a benefit to your community, I invite you to come to the Glacier Hills Project and witness  the total devastation occuring during construction.

Seeing firsthand what is happening here would turn any responsible landowner's stomach.

Heavy rains have created erosion that will take years to repair.

The number of huge construction equipment and trucks burning fuel is staggering.

Good productive farmland is being ripped apart, and will never be the same.

The level of disgust is even affecting the most loyal supporters of this project.

Hatred of this project is growing worse as each day passes, and we will be forced to live with this for the rest of our lives, all because a few irresponsible landowners, myself included, were taken in by wind developers lies.

All this for chump change.

Comments submitted by Wisconsin resident, Joe Yunk, to the Public Service Commission of Wisconsin, July 2010

My name is Joe Yunk; I currently reside at the address of N2630 Townhall Rd in Kewaunee County.

My prior address was North 7905 County Trunk P, Algoma, Wisconsin which was in the Wisconsin Public Service (WPS) wind farm by Rio Creek, Wisconsin. I moved from the Algoma address to my current address on or about October 2009 to get away from the effects of the WPS wind farm.

I have been following the current proposed Element Power LLC (EEP) wind farm development that I now find myself living in.

I want you to know what I went through while living in the WPS wind farm. I am hopeful that this information will help you make the right decisions with regard to any PSCW approvals for any other wind farms in Wisconsin.

I would hate to see other peoples’ lives to be as negatively affected as mine has been as a result of living in a wind farm. There is no doubt in my mind that I will relive the awful experience once again if the EEP wind farm for Kewaunee County is approved.

In 1998 the WPS wind farm construction began about 300 yards from my home. I had built this home in 1980 on 6.5 acres of land which was our home farm that I lived on all my life. I was born on November 28, 1954. I had two turbines within one-half mile, one of those turbines was about 1,300 ft from my house and 600 ft from my property line.

In the summer of 2000, the turbines of the WPS wind farm began operation. Inasmuch as I had lived on this farm all my life, I knew the neighbors well, and it wasn’t long after the turbines began operating our lives began to change.

In conversations with my neighbors, I learned, they too were experiencing constant disturbing noise, shadow flicker and just the constant presence of the turbines. By presence I felt uneasy and irritated by the size and closeness of these 220 ft. turbines.

All the people living in this wind farm were guinea pigs/lab rats, no one knew what we were in for. It was in the fall of 2000 when neighbors and families began to divide over the effects of the wind farm. And that continued throughout the time I lived there.

When the turbines began to operate, a hotline was established directly to WPS to report any problems.

I had beef cattle for about two years prior to the turbines operating and never lost any animals. However, shortly after the turbines began to operate, I had beef cattle become ill and die. I reported this on the WPS hotline and nothing was done. I lost ten animals valued at $5,000 [each] over a two year period and couldn’t afford to continue.

Because of noise complaints to WPS, within a year, two families’ homes were purchased by WPS and demolished.

Additionally, at the same time WPS was settling nuisance suits with other neighbors. They were offering to buy out my neighbors but offered prices way below market value to stop the complaints.

However, they never offered me any buyout opportunity and I wanted out! It was hard for me to leave my home place of 54 years. Over time, however, living with the constant sleep deprivation and irritation of the noise and flickering I decided to sue WPS to have them pay me fair market value for my home so I could afford to move.

I knew that I might be risking everything I had worked for all my life, but I didn’t care at this point. I didn’t even try to sell my place outright because I didn’t want anyone else to have to live as I did in this wind farm. I really wanted WPS to buy me out and to demolish the home.

I retained an attorney and filed suit with WPS. Shortly after, WPS offered me $110,000 on my property that appraised for $168,000. I decided not to take their offer, but proceed with the suit.

I gave deposition in the summer of 2008, we were scheduled to go trail in September 2009 and WPS offered me a settlement in August of 2009 for $163,000. With this settlement I was responsible for my attorney fees. My attorney advised me to accept this offer. After paying my attorney fees, I ended up with $158,000.

Later, my home and property were listed with a real estate agency for sale by WPS for 30% below the appraised value.

From my experience in living in this wind farm, it is apparent that setback away from property lines is absolutely necessary. I could hear the turbines a mile away from my house. The PSCW’s standard setback from a property line should be 1.5 miles.

Now, my new home and property on Townhall road is within the confines of the EPP proposed wind farm. I`d like to know what you recommend I do now?


WIND TURBINES IN THE NEWS:

Annie Hart Cool of Falmouth said a turbine was erected within 1,500-feet of her home and has disrupted her husband’s sleep so severely he’d forced to sleep in the basement. He is an air-traffic controller, she added, and can’t afford to lose sleep. And the turbine is absolutely adversely impacting property values, she said.

“Wind turbines are like living next to a train or a dump,” Cool said. “These are realities, I’m a real person and this is really happening to me.”

Dissent delays wind council’s progress

Deadline pressure and 100 amendments are cracking the unity of the states Wind Siting Council as it strives to agree on turbine placement standards.

Even the definition of agreement is a point of contention among the 15 members. The state law that formed the council requires only that the panel make recommendations that will go to the Public Service Commission of Wisconsin and, ultimately, the state Legislature.

But some council members insist they will testify against recommendations not based on a consensus vote.

“I told them they can come in with studies and articles and hearsay,” said Larry Wunsch, a Brownsville resident and council member. “I come in with experience. I live in a wind farm, and I can tell you what it looks like and how it sounds.

“But if they’re going to go with majority rule, then, yeah, I would argue against it at future hearings.”

The council is designed to establish turbine placement standards for wind farms that generate less than 100 megawatts of electricity. The PSC already reviews wind farms that generate more than 100 megawatts.

The PSC intends to finalize rules based on the council’s recommendations by Sept. 1, PSC spokeswoman Teresa Weidemann-Smith said.

Public hearings on draft rules begin next week, and the public comment period for recommendations ends July 7.

That puts the council on a tight timeline to finish its work, said Michael Vickerman, a member of the council and executive director of RENEW Wisconsin, a nonprofit organization focused on clean energy.

The council also is working through 100 amendments members proposed for the draft rules. But George Krause Jr., a council member, said the panel is moving through those amendments too fast.

“If we’re going to put something together, we need the proper time to get something done,” he said. “This is a very challenging process, and I’ve found this to be a very, very challenging council to sit on.”

But disagreement over amendments such as setbacks from property lines — rather than from buildings — is slowing the council’s progress. Although some members on Monday argued for property lines, the majority sided with setbacks from buildings.

Wunsch, who wanted setbacks from property lines, said similar divisions are forming around many council discussions. The final product, he said, could be based on the majority’s opinion rather than the full council’s.

“When it comes to property values, setback, sound and shadow flicker, I don’t think there’s going to be consensus,” Wunsch said. “I think it’s a pro-wind heavy council. I’m not there to say I’m anti-wind. I think we’ve had some good dialogue. But we have to address every issue.”

Tom Meyer, another commission member, said he too would oppose a final rule based on majority rather than consensus.

“I don’t think our role is to make turbine business easier in Wisconsin,” he said. “It’s to make rules. This isn’t a matter of compromise; it’s a matter of science.”

Vickerman said he doubts there will be consensus. But, he said, the council represents a wide array of experience and interest, and the PSC and Legislature must take that into account when approving rules for wind turbine placement.

“Those who oppose wind have already made their minds up,” Vickerman said. “We can have a dialogue with them, but I don’t think we can have a meeting of the minds.”

Public hearings are planned next week on a proposal aimed at adopting uniform siting rules for wind power projects in the state.

The public hearings and a rulemaking are part of a process launched by the state Legislature when it passed a uniform siting law last year. The legislation essentially delegated to the Public Service Commission decisions on the thorny and controversial questions raised by supporters and opponents of wind power projects at hearings in the Legislature last year.

Questions that must be resolved include how far a wind turbine must be placed from a nearby property or home, and what maximum noise standards should be. The PSC has released an initial proposal for public comment, and an advisory council created by the legislation is also studying the issue.

Public hearings will take place Monday in Fond du Lac, Tuesday, June 29 in Tomah and Wednesday in Madison. Hearings will begin at 1 and 6 p.m. each day. More details about the hearings can be found here.

The legislation was aimed at replacing a patchwork of different rules and moratoriums that have been imposed by counties and towns around the state for small wind power projects.

On Friday, the PSC commissioners approved draft wind siting rules containing conditions which include specific numbers concerning setbacks and noise limits the Wind Siting Council has never been allowed to discuss.

For those of us following this issue, this sudden move by the PSC commissioners comes as a complete surprise.

The numbers used for the draft rules come from the Glacier Hills decision, according to the commission.

The setback from non participating homes in Glacier Hills is 1250 feet. The noise limit is 50 dbA and 45dbA depending on the season.

The setbacks and noise limits previdously approved by the PSC which causing so much trouble for residents in existing Wisconsin wind projects are 1000 feet from non participating homes and a noise limit of 50dbA.

Here is a recent comment from a resident of Greenleaf, Wisconsin

I just read the last siting minutes and the draft document putting setbacks from non-participating residents at 3.1 X turbine height and "1.1" X turbine height from the property line.

In my case this is effectively stealing 690 feet of my property.

My neighbor has 138 acres and I have ten acres. If he doesn't have enough acreage to keep the 3.1 X setback from the "property line", then he does not have enough land host two turbines.

I paid off the mortgage for my land with the property rights intact and I paid the the property taxes on my land for 29 years. If there is anyone entitled to the property rights of my property- it is me.

If the state wishes to exercise eminent domain, then they have a right to do so for public conveyance and I must be compensated for the loss of my property.

The wind developer and my neighbor DO NOT have the right of eminent domain. The Wind Siting Council has a legal and moral obligation to respect the property rights of all Wisconsin property owners and any rules they make must reflect those obligations.

Some people living near wind turbines complain of chronic sleep loss, headaches and other symptoms

Wind power accounts for about 1 percent of the electricity prod­uced in the United States [source: Gillam]. Nearly 2­5,000 wind turbines crank out power throughout the country. These massive windmills -- up to 80 feet (24 meters) tall -- capture the energy in wind and convert it into free-flowing electrons that people can use to run dishwashers, air conditioning and lights.

 That 1 percent may not sound like much until you realize that wind power is just catching on in the United States. Huge new wind far­ms accounting for thousands more megawatts of capacity are in development as we speak, and estimates put 20 percent of the nation's electricity coming from wind power by 2030 [source: The Oregonian]. The European Union hopes to reach that percentage even sooner -- by 2020.

 Until recently, there were three main issues regarding the possible downsides of wind power: bird and­ bat deaths, cost, and disrupting the appearance of natural landscapes. But a new objection to wind power has popped up in the past few years, resting on the research of a few scientists. The latest argument states that wind power endangers the health of people who live near windmills. Some people call this theory "wind-turbine syndrome." Although the extent of the phenomenon is unknown, there does seem to be something to it.

 Those concerned about wind-power syndrome are interested in finding out if and how wind power could be making people sick. Is everyone living near windmills facing health probl­ems? Let's take a look at the possible health risks associated with wind farms and find out whether we should be worried about the steady increase in wind-generated power throughout the world.

 Infrasound and The Body

 The rapidly spinning blades of huge wind turbines have an effect on their surroundings, and it goes beyond aesthetics. The blade tips of a wind turbine can spin at speeds­ of up to 80 meters per second, or about 180 miles per hour. In high winds, this rapid spinning can produce sound a­nd vibration -- in addition to disruptions in air pressure [source: MIT].

 The extremely low air pressure surrounding a wind turbine could be the reason why bats die near them. A bat's lungs are very delicate, and it seems the low pressure might cause them to expand to the point of bursting blood vessels [source: NewScientist]. Scuba divers can certainly attest to the effects of pressure on the human body.

 And the corporeal effects of sound -- essentially fluctuations in air pressure that vibrate the eardrum -- are well-documented. For instance, infrasound -- sounds at such low frequency that they can't be picked up by the human ear but can carry through the atmosphere for thousands of kilometers -- is believed to cause certain breathing and digestive problems [source: Infrasound Lab].

 Infrasound is the primary issue for those concerned about wind-turbine syndrome. They also say that audible sound and vibrations contribute to the health problems reported by some people who live close to wind farms. Symptoms of wind-turbine syndrome might include:

    * headaches

    * sleep problems

    * night terrors or learning disabilities in children

    * ringing in the ears (tinnitus)

    * mood problems (irritability, anxiety)

    * concentration and memory problems

    * issues with equilibrium, dizziness and nausea

 Around the World

 As of May 2008, about 25,000 wind turbines are cranking out power across the country -- and the world [source: Gillam]. In Britain, 2,100 turbines supply up to 2 percent of the country's power; Germany, the world's top user of wind power, draws 7 percent of­ its electrical needs from more than 19,000 turbines [source: BBC,BWEA].

 These symptoms have been observed and documented by a limited number of scientists studying small groups of people, and the scientific community hasn't conclude­d whether wind-turbine syndrome exists.

 There are also mixed opinions on whether wind turbines emit infrasound and if the amount is any more than that emitted by diesel engines or waves crashing on the beach [source: CleanTechnica, ABC Science]. But we do know that at high speeds, wind turbines can produce an audible hum and vibration that can be carried through the air. ­It's these sounds and motions that provide clues and possible solutions to wind-turbine syndrome, which we'll explore in the next section.

 Wind-Turbine Syndrome Explanations and Solutions

 It's understood that some people who live in close proximity to wind turbines experience sleep disturbances, headaches and concentration problems. These symptoms and others could be explained as the effects of infrasound as well as constant humming and vibrations.

 But here's the catch: Many of the symptoms of wind-turbine syndrome can also be caused by chronic sleep loss -- simply and unfortunately an effect of living near a noise-producing entity [source: ­­Ohio Department of Health].

 People who live near a highway or busy street may have trouble sleeping, which can lead to other health problems like irritability, anxiety, concentration and dizziness.

 Infrasound Weapons

 There was a rumor years ago about an infrasound-based military weapon that would make people lose control of their bowels and poop on themselves. It was said to be a riot-control device. The rumor wasn't true, as far as we know [source: ABC Science]. But in theory, such a weapon might work.

 To solve this sound issue, new wind-power technology employs sound-dampening systems. Engineers are hoping that these newer systems -- which can block or cancel out multiple sound frequencies -- will reduce any sound-related problems associated with wind farm communities [source: Fraunhofer-Gesellschaft].

 Researchers studying wind-turbine syndrome also recommend a larger buffer zone around wind farms to protect people from any ill effects. Some people say that the distance should be least 1.2 miles (2 kilometers) [source: CleanTechnica].

 Others suggest at least 2 miles (3.2 kilometers) [source: PlanetGore].

 Some wind farms are currently located as close as a half mile (0.8 kilometers) from residential areas.

 Whether we should be concerned with the expansion in wind power ultimately comes down to weighing the pros and cons. Is cleaner, cheaper, domestically produced energy worth the potential side effects of some people experiencing headaches? The hope is that new buffer-zone regulations and sound-canceling technologies can do away with the question entirely.

 If the issue persists, we'll have to decide whether wind power is important enough to pursue anyway -- much like deciding whether building a new, noisy highway that would reduce congestion and increase commerce is worth some unfortunate people losing sleep.

INVENERGY TRIES TO WOO BROWN COUNTY FOR WIND FARM PROJECT

Invenergy LLC officials say they have a track record of profitable projects and satisfied customers to support their efforts to bring a wind farm to Brown County.

“If one looks overall at this, they’ll see there’s a high level of comfort,” said Kevin Parzyck, project manager for the proposed 100-turbine Ledge Wind Energy Project in four towns in southern Brown County. “Our feeling is that it’s a benefit to the community.”

Invenergy, one of the six largest wind energy companies in the country, according to the American Wind Energy Association, wants the local project to become its 23rd wind farm in the United States.

It awaits siting guidelines from the Wisconsin Public Service Commission as it fends off opposition from a citizens group that is protesting the location in Morrison, Wrightstown, Glenmore and Holland.

The PSC is expected to announce the guidelines by July, and Invenergy plans to resubmit its proposal based on those rules.

Many property owners in Brown County have signed contracts with Invenergy to permit wind turbines on their land in exchange for annual payments of approximately $8,000. Other property owners insist that the wind turbines will have negative health and safety impacts and will reduce property values.

But Invenergy officials say they have public opinion on their side.

The Wisconsin Legislature has been debating a bill that would require one-fourth of the state’s energy to come from renewable sources by 2025. And a poll commissioned by the American Wind Energy Association claims that 89 percent of American voters believe that increasing reliance on wind energy is a good idea.

Parzyck said the proposed wind farm in Brown County is not a reckless plan and has the potential of being a $300 million project when completed.

“There has to be a rock solid plan in place if you’re going to have a huge upfront investment,” he said.

The opposition group, Brown County Citizens for Responsible Wind Energy, is misinforming the public, he said.

“The one thing I would say is this group is extremely well-funded and well connected statewide,” he said.

“They have said they do not believe renewable energy makes sense in Wisconsin, but that flies in the face of what the Legislature and electorate has asked for. And they haven’t offered any alternatives.”

The citizens group has said it doesn’t oppose wind turbines but objects to their locations. The decisions on where to locate the turbines were based on the towns’ zoning ordinances at the time, Parzyck said.

Bill Hafs, the county’s land and water conservation director, said he has been in contact with Invenergy officials to discuss the possible impact of wind turbine construction on groundwater. But he said the county has no say on the wind farm issue.

Invenergy’s financial worth isn’t disclosed because it is a privately owned company. It has wind farms in 14 states and one in Canada.

The American Bird Conservancy says it fears proposed voluntary guidelines for wind farms will not prevent the deaths of birds by the turbines.

ABC President George Fenwick said Monday he sent letters to Secretary of the Interior Ken Salazar and Bureau of Land Management Director Bob Abbey identifying key shortcomings in recent federal plans to address the affects of wind farms on birds.

“I find it ironic that the Interior Department is asking us to believe that the wind industry will follow voluntary guidelines when their own land management agency is not even doing so,” Fenwick said.

Fenwick said the Fish and Wildlife Wind Advisory Committee has made excellent recommendations for the generation of wind power that the conservancy wants adopted throughout the federal government. But Fenwick said the major shortcoming in the recommendations is that they are proposed as voluntary, rather than mandatory, and as such will do little to curb unacceptable levels of bird mortality and habitat loss at wind farms.

“The notion that the wind industry is predominantly made up of small, environmentally conscious operations is one that must be quickly dispelled,” Fenwick said. “These are large, corporate-scale utility companies, not unlike coal and oil conglomerates … with a checkered environmental track record to date. Voluntary guidelines will not change that paradigm, and will work about as well as voluntary taxes.”

The Bat in the Wind Turbine Facility… Today’s Canary in the Coal Mine

Things are going badly for our wildlife populations in and around the operating industrial scale wind projects in Wisconsin.

Anecdotal reports from people living in Wisconsin wind projects report an absence of normal wildlife, i.e. no turkey, no deer, fewer or no songbirds, and no bats. Relatives and friends outside the wind facility report greater numbers of deer and turkey.
 
 The birds and deer are leaving the area, but the bats are as likely to be dieing, as leaving.

A recent post-construction bird and bat mortality report, conducted by We Energies (WEPCO) CLICK HERE TO DOWNLOAD  as part of receiving approval for it’s Blue Sky Green Field project, shows that the bird deaths were 11 to 12 bird deaths/per turbine/per year. This is four times higher than the national average of 3 bird kills/per turbine/per year.

Even more alarming are the bat kill rates of 40.54 to 41/per turbine/per year This is more than ten times the reported national average of less than 4 per turbine per year.

Wisconsin's turbine related bat deaths are among the highest in North America, and equal to the bat mortality numbers from Pennsylvania/Appalachia area which stunned conservationists across the nation.

The total number of bats killed by the 88 turbine Blue Sky Green Field project is estimated to be between 3,500 to 3,600 per year.

Two additional post construction reports show the same bat kill rates at the Cedar Ridge project, and slightly higher kill rates at Invenergy Forward Energy project near the Horicon Marsh.

These three projects alone have resulted in an estimated 8,000 bat deaths per year.

That's 16,000 dead bats for the two years these projects have been in operation.

According to page 66 and 67 of the Public Service Commission's Environmental Impact Statement, the bat kill numbers for the pending Glacier Hills wind project are expected to be equally as high, adding at least another 3500 turbine related bat deaths per year.

Can Wisconsin bat populations sustain this kind of impact?


Bats are not being struck by the blades (135 feet long with tip speeds of 180mph), but are suffering catastrophic damage to their lungs as they fly into the low-pressure zone that is created behind the rotating blades.

This drop in pressure causes their lungs to expand rapidly, burst, fill with fluid and blood, and they drown. It is called barotrauma – deep-sea divers get a version of it called the bends, when raised too quickly from the depths.

Birds have different lung structures, so they are not as readily affected, but bats are mammals and have lungs much more similar to ours, so take a deep breath, and imagine you can’t stop inhaling until your lungs burst. 
 
Bats live up to thirty years, reproduce slowly, maybe one pup a year, and and because they maintain tight family groups, the loss of a single bat can have a significant impact.

Bats are a vital link in the natural balance of Wisconsin’s wild and not so wild areas.

I cannot think of a time in human history that bats have not been flying over Wisconsin, but the loss of our bat population could happen in our lifetimes.
 
White nose syndrome, a nasal/respiratory fungus, is threatening cave roosting/hibernating species of bats, in the eastern United States into extinction, but has not yet reached Wisconsin.

Industrial wind turbines kill all species of bats, even the tree roosting/migrating species we hoped might be spared from the white nose blight.

If the state continues to follow its plan to add 200 to 300 new industrial turbines each year until 2025, turbine related bat deaths could be as high as 131,200 to 192,700 bats per year.
 
This total annual mortality number is unlikely, because the remaining bat populations would likely crash from mounting annual losses before then.
 
I am asking that  we, as conservationists, help stop this needless slaughter.

My main concern is that there is no representative of any organization with expertise in wildlife and natural habitat protection on the Wind Siting Council. The Wind Siting Council is a 15 member organization currently working on creating guidelines for siting wind turbines in our state.
 
I am asking that the DNR require the PSC to stop the operation of industrial scale wind turbine facilities at night (curtailment) when electrical demand is low and easily met by existing base load generation which cannot be shut off. 

The period from dusk until dawn must be reserved for migrating and feeding wildlife as an equitable distribution of a state (“free wind”) natural resource, for the greater good of the whole rural community, human and animal. Night time curtailment would ensure safe passage for bats and night migrating birds, and provide a reliable period of quiet for the undisturbed sleep that is vital to any being's health.
